OPTI SHACK INC, doing business as LENSHAUS (“LENSHAUS,” “we,” “us,” or “our”), operates this store and website, including related information, content, features, tools, products, and services (the “Services”). We use Shopify to support checkout, payment processing, order management, and related commerce services.

This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase through the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls regarding the collection, processing, and disclosure of personal information.

Please read this Privacy Policy carefully. By using the Services, you acknowledge that you have read and understand this Privacy Policy. Using the Services or making a purchase does not, by itself, constitute consent to receive text messages.

Personal Information We Collect or Process

“Personal information” means information that identifies or can reasonably be linked to you or another person. It does not include information that has been anonymized or de-identified so that it cannot reasonably be linked to a person.

Depending on how you interact with the Services, where you live, and applicable law, we may collect or process:

  • Contact details: Your name, billing address, shipping address, phone number, and email address.

  • Payment and financial information: Payment method, payment confirmation, transaction details, and payment information processed through our payment providers.

  • Account information: Login credentials, preferences, and settings when you create or use an account.

  • Transaction information: Products you view, add to your cart, purchase, return, exchange, or cancel, and your transaction history.

  • Order specifications: Prescription and measurement information, frame photographs, and lens selections you choose to provide to prepare your order.

  • Communications: Information you provide when contacting us for support or otherwise communicating with us.

  • SMS preferences and consent records: Your mobile number, consent selection, time of consent, source page, disclosure wording and version, and opt-out requests.

  • Device information: Information about your device, browser, network connection, IP address, and other identifiers.

  • Usage information: Information about how and when you access, use, or navigate the Services.

Personal Information Sources

We may collect personal information:

  • Directly from you when you place an order, create an account, complete a form, upload order information, contact us, or otherwise provide information.

  • Automatically through the Services, including through cookies and similar technologies.

  • From service providers that support payments, order processing, shipping, communications, analytics, and other business functions.

  • From partners or other third parties where permitted by applicable law.

We do not obtain consent for our SMS program through purchased lists, shared consent, or third-party lead lists.

How We Use Your Personal Information

We may use personal information for the following purposes:

  • Provide and improve the Services. To process payments, prepare and fulfill orders, remember preferences, manage accounts, arrange shipping and returns, process exchanges, provide order notifications, enable reviews, and improve the shopping experience.

  • Prepare your lenses. To process prescription, measurement, frame, and lens-selection information needed to evaluate and fulfill your order.

  • Marketing and advertising. Where permitted, to send promotional communications by email or postal mail and display advertisements. You may unsubscribe from promotional emails using the link in those messages. Our transactional SMS program does not send promotional text messages. The SMS information restrictions below apply to all marketing and advertising activities.

  • Security and fraud prevention. To authenticate accounts, protect payments and transactions, investigate suspected fraud or misuse, and help keep the Services secure. If you create an account, you are responsible for protecting your login credentials.

  • Communicate with you. To answer questions, provide customer support, resolve order issues, and send requested service communications.

  • Legal purposes. To comply with applicable law and valid legal process, resolve disputes, enforce our policies, and protect our rights and those of others.

SMS Communications and Order Processing

Our transactional SMS program

OPTI SHACK INC, doing business as LENSHAUS, operates the optional LENSHAUS Order & Pickup Updates SMS program.

This program sends automated transactional text messages about your order, mailer delivery, pickup scheduling, pickup requests, confirmed carrier pickups, and shipping updates. It does not send promotional messages or prescription details.

Shopify supports our checkout and order-processing functions. Completing checkout, placing an order, or providing a mobile number does not automatically enroll you in text messages and does not constitute consent to SMS marketing.

How you consent

To receive program messages, enter your mobile number and actively select the optional, unchecked SMS consent box in the contact and delivery information step of your order.

Consent is not a condition of purchase. You may complete your purchase without agreeing to receive texts. Providing a phone number alone does not enroll you.

We record your consent selection with your mobile number, the time it was recorded, the source page, and the disclosure wording and version. We also process messaging and opt-out information as needed to operate the program and honor your preferences.

Frequency, charges, and support

Message frequency varies based on your order, mailer delivery, pickup, and shipping activity. Message and data rates may apply according to your mobile plan.

Reply STOP to unsubscribe. You may receive a final message confirming your opt-out. Reply HELP for assistance or contact support@lenshaususa.com or +1 954-744-9461.

You may continue receiving essential order information by email after opting out of text messages.

Mobile information and consent protections

We do not sell or share mobile numbers, SMS opt-in data, or text message consent with third parties or affiliates for marketing or promotional purposes.

We may provide the minimum information necessary to service providers that help us process orders, deliver messages, provide customer support, and fulfill shipments, solely to perform those services. We may also disclose information when legally required.

The marketing, advertising, affiliate-sharing, and other general disclosures elsewhere in this Privacy Policy do not permit the use or sharing of mobile numbers, SMS opt-in data, or text message consent for marketing or promotional purposes. Consent to this program is specific to LENSHAUS and is not transferred to another brand for its messaging program.

For additional information, see our SMS Privacy Policy and SMS Terms.

How We Disclose Personal Information

Subject to the SMS protections above, we may disclose personal information:

  • To service providers: Including Shopify and providers supporting payments, technology, customer support, cloud storage, analytics, messaging, fulfillment, and shipping.

  • To business and marketing partners: Where permitted, to support advertising and marketing services. Mobile numbers, SMS opt-in data, and text message consent are excluded from disclosures for marketing or promotional purposes.

  • At your direction: When you request or authorize a disclosure, such as sharing shipping details with a carrier or using an integrated third-party service.

  • Within our corporate group: As needed for legitimate business operations, subject to this policy and its SMS restrictions.

  • For legal and business purposes: In connection with a merger, acquisition, bankruptcy, or similar transaction; to comply with applicable law or valid legal requests; to enforce our terms; or to protect the Services, our rights, and the rights of others. These circumstances do not authorize transferring SMS consent for another brand’s marketing program.

Depending on where you reside, you may have the right to opt out of certain disclosures for targeted advertising. You can submit a request through our data-sharing opt-out page.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you.

In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes.

To learn more about how Shopify uses your personal information and any rights you may have, visit the Shopify Consumer Privacy Policy. Depending on where you live, you may exercise certain rights through the Shopify Privacy Portal.

Third-Party Websites and Links

The Services may contain links to websites or platforms operated by third parties. If you follow those links, review their privacy policies and terms.

We do not control those third parties’ privacy or security practices. Information you share in public or semi-public areas, including on social media, may be visible to others. Providing a link does not by itself mean we endorse the linked service or its content.

Prescription images, measurements, and frame photos

If you upload an eyeglass prescription, Lenshaus sends the file (JPEG, PNG, WebP, HEIC, HEIF, or PDF, up to 10 MB) to OpenAI to read the values. That request tells OpenAI not to store the upload for later retrieval. A PDF is sent with the file name you gave it. Lenshaus does not save the image or PDF in its order database. Your browser can show a preview during that visit. The values are saved on the order once you continue: sphere, cylinder, axis, reading addition (ADD), prism, pupillary distance, and any prescriber name or expiration date on the file. You can type those values instead of uploading a file.

You can also submit pupillary-distance and fitting-height photos in the measurement tool. Those photos and the measurements taken from them are stored with the order until that measurement is reset or you ask us to delete them.

Frame photos (a front view, plus optional side and top views) are re-encoded as JPEG images and stored in our private database with the order. There is no public link to them. If you use the lens preview, the photo is also sent to OpenAI. OpenAI does not use API data for training, keeps no application state for image edits, and may keep abuse-monitoring logs for up to 30 days. Your browser keeps a local copy of the current order's frame photos and stops using that copy after 7 days. That local limit does not delete the database copy.

We use this information to make your lenses, to ask you to confirm values before checkout, to let the lab check the frames and the prescription, and to handle support and remakes. We do not sell it, and we do not use it to bill any health insurance, Medicare, Medicaid, or vision plan.

Shopify receives checkout and order details, including whether the order uses a prescription and which lens options you bought. Shopify does not receive the prescription numbers, the prescription image, the prescriber name, pupillary distance, prism, or frame photos. Lenshaus staff can view the saved prescription and frame photos. When review email is turned on, a prescription summary and the frame photos are emailed to the lab that makes the lenses and to Lenshaus support. The website is hosted on Vercel. Orders are stored in a private Postgres database. Review email is sent through Resend when that email is turned on.

The site does not delete unpaid orders, prescription values, or these images on a timer. We keep them with the order so we can make the lenses, handle remakes and support, and meet legal duties. You can ask us to confirm, access, correct, or delete this information, or to withdraw permission to keep using it, by emailing support@lenshaususa.com or calling 954-744-9461. We may need to confirm the request is yours. We may limit deletion when we still need the information to finish your order or to meet a legal duty. If we deny a request, you can appeal by emailing the same address with "Appeal" in the subject.

A separate Consumer Health Data Privacy Policy describes these practices in more detail: https://lenshaususa.com/policies/consumer-health-data-privacy

Children’s Data

The Services are not intended for use by children, and we do not knowingly collect personal information directly from children under the age of majority in their jurisdiction.

If you are a parent or guardian and believe a child has provided us with personal information, contact us using the details below to request its deletion, subject to applicable legal requirements.

As of this policy’s effective date, we do not have actual knowledge that we sell or share, as those terms are defined by applicable law, personal information of individuals under 16 years of age.

Security and Retention of Your Information

No security measures are perfect, and we cannot guarantee absolute security. Information sent over the internet may not be secure while in transit. Avoid sending sensitive information through unsecured channels.

We retain personal information for as long as reasonably needed to operate the Services, fulfill orders, maintain accounts, provide support, honor communication preferences, comply with legal obligations, resolve disputes, and enforce agreements.

We retain consent and opt-out records as needed to administer our SMS program, demonstrate consent, and prevent messages from being sent contrary to your preferences.

Your Rights and Choices

Depending on where you live, you may have the following rights, subject to applicable conditions and exceptions:

  • Access or know: Request information about the personal information we hold about you.

  • Delete: Request deletion of your personal information.

  • Correct: Request correction of inaccurate personal information.

  • Portability: Request a copy of your personal information or its transfer where applicable.

  • Opt out of sale, sharing, or targeted advertising: Request that your information not be used or disclosed for certain advertising purposes.

You can exercise applicable advertising opt-out rights through our data-sharing opt-out page.

Where applicable, we recognize Global Privacy Control signals as an opt-out request for the browser or device sending the signal. If we can associate the signal with a Shopify account, the request may also apply to that account. Learn more at Global Privacy Control. Other than Global Privacy Control, we do not recognize other “Do Not Track” signals.

Communication preferences

You can unsubscribe from promotional emails using the unsubscribe link in those emails. We may still send non-promotional emails about your account, purchases, or requested services.

For our SMS program, reply STOP to unsubscribe or HELP for assistance. Withdrawing SMS consent does not prevent you from purchasing or receiving essential order information by email.

You may also exercise applicable privacy rights by contacting us using the details below. For information about rights relating to data processed by Shopify, visit the Shopify Privacy Portal.

We will not discriminate against you for exercising applicable privacy rights. We may need to verify your identity before processing a request. Where permitted, you may authorize an agent to act on your behalf; we may require proof of that authorization and verification of your identity. We will respond within the time required by applicable law.

Complaints

If you have concerns about how we handle personal information, contact us using the details below.

Depending on your location, you may have the right to appeal a decision concerning your privacy request or lodge a complaint with your local data protection authority.

International Transfers

We and our service providers may transfer, store, or process personal information outside your country.

When transferring personal information outside the European Economic Area or United Kingdom, where applicable, we rely on recognized transfer mechanisms, such as Standard Contractual Clauses or equivalent safeguards, unless the destination has been recognized as providing an adequate level of protection.

Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our practices or for operational, legal, or regulatory reasons. We will post the updated policy, revise the “Last updated” date, and provide additional notice when required by law.
